Constructon company in our Neighborhood

Ed, the support boards returned yesterday.

Today, the truck was over there with two guys working for quite a while > now, the pile of boards is even higher than yesterday. It is huge.

I don’t know if they brought more boards or if they moved other piles into one large pile.

In any case, the construction storage lot is still going and the pile of wood is very visible from my front porch. Obviously the larger pile is very visible from the street also.

When the construction company first started this thing, they had a couple modest piles of lumber covered by black plastic. I thought this lumber was for their future house. In fact those piles never changed. I hardly paid attention. But somewhere along the line, they started leaving the trailer parked here and the boards started coming and going. It became apparent that they were using the lot for active construction storage. Soon afterwards, the pile of construction rubbish appeared and the abandoned car showed up.

The active storage lot contradicted what the lady told me about their business plan. After she told me they were going to move a business here, I told her that was against the restrictions. She assured me that ‘all the lumber was sent to the job and that they wouldn’t [be a lumber yard]. However that is not true because in addition to the support boards, they were moving new lumber into the garage a few days ago. I was a carpenter for 30 years and I know what a new board looks like.

If these people want the freedom to use their property any way they want, why don’t they build a barn out in the country? It seems to me they are here because the neighborhood protects their property > in other words nobody pilfers their stuff when they’re not around. They wouldn’t have the same peace of mind out in the country somewhere.

These people are using our property values to protect themselves, but in return for the security brought by our restrictions they are demanding that we erode our restrictions for their benefit. I built a house here because of the restrictions, I support the restrictions, but now these people are leveraging my property rights to put money in their pocket. This compromises my long-term security.

Dang it Ed, I don’t want to live next door to a business. Ten years from now I don’t want bars on my windows because parolees are wandering our streets during their lunch hour looking for job opportunities. Furthermore, I am convinced that these people will keep coming at this neighborhood until we give up and they got a construction company and auto repair shop and all manner of business activity any time of the day and night.

I prefer that this whole matter be put to a rest once and for all.

Ed,

I want to revisit the ‘construction company’ situation from next door. They should bring the entire property up to community standards and keep it at that standard.

Frankly, I can see everything in their yard while standing on my front porch > or back porch > or back yard. They have a dump over there.

When we walked over there today, we observed an active material drop site.

The people may claim they are dropping lumber for use on their house.

This assertion is untrue since the deed restrictions prohibit used lumber on new construction.

We observed used materials. Everything over there looks like it was pulled off a construction site.

If they were saving lumber for a house, it wouldn’t have nail holes in it. Nor would they have piles of uncovered boards. Nor would they have a smattering of this board and that.

Furthermore the garage is not a lone outbuilding awaiting a house. They are running vehicles into and out of the property on a regular basis which implies that they are using the property. They park the trailer there for 3-4 days at a time. They now have a car parked there. They load and off-load after hours. They are using the lot.

If they are using the lot, then they should conform completely to community standards. Yet they have no driveway. The restrictions say that a driveway has to be in place within so many days after completion of construction.

I think the continual use of the property warrants a strict enforcement of restrictions.
> Remove their dump piles
> Remove the piles of boards from sight since they are not intended for use on their house
> Remove the stored vehicle and trailer, or put them on a driveway
> Put in a driveway (or quit driving over there every third day)
> Keep the grass mowed [and edged] the same as other folks here.

These people are using our property values to protect their interests without regard to their responsibilities. If they want the security of a neighborhood to guard their interests, then they should pay back the people who provide the security. Otherwise they can build out in the open countryside where anybody can drive up unnoticed.
